Settlement – Indefinite Leave to Remain

Settlement, also known as Indefinite Leave to Remain (“ILR”) is a legal authority which allows you to live and work in the UK permanently without being subject to immigration control. You will also have access to benefits such as government-funded medical care, education, and a pathway to British citizenship.  Settlement can be granted if you have been residing continuously in the UK for 2, 5, 10 or 20 years depending on your visa route and your circumstances.  For some categories, you may apply under the accelerated route if you qualify.

As a general principle, you need to meet the following key requirements:

  • You must have resided lawfully in the UK continuously for 5 or 10 years with no absences totalling more than 180 days in any 12-month period during your lawful stay.
  • You must be of good character, not in breach of the immigration rules or have committed any criminal offences during your stay.
  • You must demonstrate knowledge of English language and life in the UK by passing the Life in the UK test or having a speaking and listening qualification in English at level B1 or higher.

To apply for settlement, you need to complete the relevant form as suited to your respective category and submit it to the Home Office along with your supporting documents.
