Compliance
The UKVI places significant trust in sponsors to ensure that they are complying with their sponsorship duties. The aims of these duties are to monitor compliance with the immigration rules, prevent abuse, capture early signs of uneasy migrant behaviour, which may be of concern and identify any weaknesses.
You as the sponsor have a duty to comply with the UK immigration rules as well as ensuring that the job offer is genuine that meets the requisite skill level and rate of pay. Further, you must show that the migrant will perform specific duties and responsibilities for the job.
You also have a number of record-keeping and reporting duties such as maintaining up to date contact details for each migrant, keeping a host of documentation, monitoring migrants’ attendance, reporting any significant changes and ensuring that your sponsor management system is up to date. You also have a legal duty to prevent illegal working and must identify those migrants who require permission to work in the UK and accurately undertake prescribed document checks.
The UKVI Officer may visit you during the validity period of your licence. These visits can be announced or unannounced and any non-compliance may lead to your licence being suspended, revoked or downgraded.
