We act for individuals employed in the care sector as well as employers who own care and residential homes.
If you are an employee and have been informed by the Secretary of State that you are to be included on the Protection of Vulnerable Adults (POVA) List and/or the Protection of Children Act (POCA) List, we can assist with regards to appealing the decision. Our solicitors have represented many individuals regarding POCA and POVA matters and we can assist with developing your case and also seek expert testimony on your behalf as and when required.
In most circumstances, the Secretary of State for Health, Secretary of State for Education and Skills or the Independent Safeguarding Authority (ISA) would have reached a decision to restrict or bar an individual from working with children or vulnerable adults and made decisions to cancel, vary or refuse registration. Having received a decision that you do not agree with, you can appeal if you are:
- A child minder or other child care provider
- A care home manager or provider
- A children’s home manager or provider
- An independent healthcare manager or provider
- The provider of an agency that delivers personal or nursing care in someone’s home
- The provider of an agency that delivers fostering or adoption services
- A social worker or social care worker.
- Have been barred from teaching or otherwise working with children.
- Have been barred from working with vulnerable adults.
In addition to the above, Axiom Stone can also represent you if you would like to appeal a decision of a Secretary of State in the following types of matters:
- If you are a teacher working with children and have been restricted or prohibited to work alongside them in school or other education establishment.
- If you are an independent school and your registration has been terminated.
- If a decision of the Care Quality Commission and the Welsh Assembly Government has been made against you, for example, if you are a:
- Care home
- Residential Family Centre
- Domiciliary Care Agency or a Fostering Agency or Voluntary Adoption Agency
- Nursing Agency
- An independent hospital, medical agency or clinic
- NHS provider of healthcare services
- If a decision of the Chief Inspector of Schools in England (Ofsted) and the Welsh Assembly Government has been made against you concerning disqualification or registration under the Early Years Childcare Register or General Childcare Register
- If you are a Social Worker or Social Care Worker and the matter concerns your registration at the General Social Care Council and the Care Council Wales.
