Arbitration is a form of alternative dispute resolution brought outside of court. Parties normally invoke this procedure if the agreement between them allows arbitration proceedings to be conducted. i.e. agreements between parties will include an arbitration clause.
If not mandatory, parties can still agree to enter arbitration. Proceedings are conducted in an informal manner compared to the normal court procedure, however, any decisions reached are binding upon parties.
